In order to legitimately process this type of data, before providing it, you will be asked to express your specific and explicit consent, as required by Article 9 paragraph 2 letter a) of the GDPR.

3. PURPOSES AND LEGAL BASIS OF THE PROCESSING

The processing of your personal data is aimed at allowing Enrico Battistini to perform the services and provide you with the service you requested. Your data will be processed in compliance with all other obligations established by current legislation.

Your special personal data will be processed solely for the purpose of providing you with the requested service, subject to your explicit consent. The provision of data, both common and special, is optional, but failure to provide it will make it impossible to conclude the contract and provide the service you requested.

Enrico Battistini may also use the data you provide, specifically your name, address and e-mail, to carry out promotional, updating, corporate communication, and direct marketing activities by post, e-mail and SMS. These processing operations may only be carried out after you have given your specific consent, which may be revoked at any time, without however affecting the lawfulness of the processing carried out prior to its revocation.

4. DATA COMMUNICATION

Your data may be communicated to public, social security and welfare, and security bodies, and more generally to public administration offices for the fulfillment of obligations established by law. They may also be communicated to judicial and administrative authorities, in accordance with the law, to allow Enrico Battistini to exercise or protect its own or third-party rights before the competent authorities, as well as for other reasons related to the protection of the rights and freedoms2 of others.

Your personal data will under no circumstances be subject to dissemination.

5. PROCESSING METHODS

Your personal data will be processed by Enrico Battistini, duly authorized pursuant to Article 4, paragraph 10, of the GDPR and Article 2-quaterdecies of Legislative Decree 196/2003, and only under specific instructions from the Data Controller; these individuals will also be bound by the strictest confidentiality.

The processing of your personal data is based on the principles of correctness, lawfulness, transparency and minimization; it may take place using both paper and IT tools suitable for guaranteeing security and confidentiality. Enrico Battistini does not use any fully automated decision-making process for your personal data.

6. RETENTION PERIOD

Your personal data, processed for promotional and direct marketing purposes, as well as to offer you a personalized assistance service, will be kept until you revoke your consent.

7. RIGHTS OF THE DATA SUBJECT

Among the rights recognized by the GDPR are those to:

– request from the Data Controller access to your personal data and information relating thereto; the rectification of inaccurate data or the integration3 of incomplete data; the deletion of personal data concerning you (upon the occurrence of one of the conditions indicated in Article4 17, paragraph 1 of the GDPR and in compliance with the exceptions provided for in paragraph 3 of the same article); the limitation of the processing of your personal data (upon the5 occurrence of one of the hypotheses indicated in Article 18, paragraph 1 of the GDPR);

– request and obtain from the Data Controller – in cases where the legal basis of the processing is6 the contract or consent, and the7 processing is carried out by automated means – your personal data in a structured and machine-readable format, also for the purpose of communicating such data to another data controller8 (so-called right to data portability);

– object at any time to the processing of your personal data if9 there are particular situations concerning you;

– revoke consent at any time, limited to cases where the processing is based on your consent for one or more specific purposes.10 The processing based on consent and carried out prior11 to its revocation remains, however, lawful;

– lodge a complaint with the Data Protection Authority (www.garanteprivacy.it).
